Geneva's attorney general, Olivier Jornot, clarified that the police should no longer prosecute beggars until further notice. Jorno explained that the ECHR in Strasbourg concluded that Switzerland had violated the fundamental right to respect for private life.

Back in 2014, a 22-year-old Romanian woman was fined 500 francs for begging on the streets of Geneva. In three years, the woman violated the current ban on begging nine times. Since she had no other sources of income, she spent the funds raised on meeting the most important life needs. The Romanian was unable to pay the fine and was sentenced to 5 days in prison.

According to the ECHR, the punishment does not correspond to the gravity of the crime. The prohibition on begging in this particular case did not allow making a correct assessment of the balance of interests of the parties. Now the Geneva prosecutor's office is pushing for amendments to the ban law, which has been in effect in the city since 2008.

It is proposed to toughen the responsibility for "aggressive" begging, begging with children or in certain places, but in general this kind of activity should not be prohibited.
