MOSCOW, February 7. / TASS /. The girl's mother, who has not been taken out of the clinic for five years, filed a complaint against the Presnensky court judge Natalya Karzhavina, who decided to limit the parents' rights to the child and transfer her to the guardianship authorities.
"I ask you to initiate disciplinary proceedings against the federal judge of the Presnensky District Court of Moscow, Karzhavina NS, for the procedural violations," says the complaint of the girl's mother Tatyana Maksimova to the qualification collegium of judges, the text of which was reviewed by TASS.
The document notes that during the meeting, the petitions made by Maximova's lawyers to request written evidence in this case, to which the plaintiffs refer orally, Judge Karzhavina did not accept and refused to conduct a forensic medical examination with a physical examination of the girl, and also considered the case in the absence of Maximova, who was on sick leave.
All this, according to the applicant, is a violation of the Civil Procedure Code of the Russian Federation.
On February 5, the Presnensky Court of Moscow decided to transfer Maksimova's daughter to the guardianship authorities. Born in 2014 at the Mother and Child clinic on Sevastopolsky Prospekt in Moscow, the girl was returned by her mother to the neonatal pathology department of this clinic after being discharged. The child has been in a medical facility for five years. According to the press service of the medical center, the girl's health is not currently threatened.
As follows from the court's database, lawsuits have already been filed against the child's parents for restriction of parental rights, but they were rejected.
