“Our parents are free to choose the way of raising their children, but this freedom is limited by the prohibition of cruelty to children, there is a corresponding article in the Criminal Code. According to the Family Code of the Russian Federation, if there is abuse of children or a threat to their lives, then the guardianship authorities can immediately take them away from their parents. In addition, there is an article on depriving parents of parental rights, which says that parents, despite all the discretion in raising children, cannot exercise their parental rights in conflict with the interests of children and harm their mental health, physical health and moral development. Education should exclude dismissive, cruel, rude, derogatory attitude and exploitation, that is, there is a toolkit that prohibits parents from harming children in the legislation,”Dergunova explained.
According to her, in the case under discussion, judging by the information presented in the article, the mother was already taking the children into the forest. It is obvious that she not only improperly exercised parental rights, but actually put the children in a situation of threat of harm to their physical and mental health.
“Of course, in this situation, the guardianship authorities should, at least, intervene and register the family as dysfunctional, and at least take preventive measures, and, as a maximum, take the children away so that there would be no recurrence. And the question is, where was dad all this time? Why was he not informed? And if the Pope is deprived or limited in his rights, then on what grounds? We are told about the mother's behavior, while there is no clarity about the second parent,”the lawyer added.
We will remind, the media reported about a resident of Tatarstan, who on April 5 with her two sons went into the forest 3 km from the nearest settlement. There the mother built a hut where they lived. She fed the children with leaves. Two weeks later, one of the boys managed to escape. The children were hospitalized with exhaustion, and the mother explained her behavior by saying that she "did not want her children to have chips implanted."
